Why People Prefer Pro Se Representation People would desire to represent themselves in court pro se, mainly for the reason that they have a di strust for lawyers in general. Others believe that they can personally deal with their defense effectively, and others will seek to represent themselves owing to their lack of qualification for legal aid and hiring a private lawyer turns out to be expensive (Harr, Hess, & Orthman, 2012 387). ... with complexities, thither should be a right to self-representation but this should only be based on the intricacy of the case as well as the formality of the make out (Harr, Hess, & Orthman, 2012 390). Notably, when individuals represent themselves they are accorded the possibility to truly articulate what they feel instead of having their insight filtered through the lawyer. However, when it comes to criminal trials, self representation should not be in place due to the complex nature of the trial process. In complicated trials it is difficult even for the most intelligent and educated citizen to learn the complex aspects of the law, and as a result precise court procedure can be complica ted and stressful. Thus, the objective for a lawyer in complicated cases rather than self representation is to safeguard the integrity of the procedure and to guarantee a fair trial (Harr & Hess, 2007 388). Trial by Media Limitation Even though, a public trial advances the fundamental fairness of the trial as well as the position of fairness when it comes to enhancing public confidence, there has to be a balance between the ordinal amendment right of the defendant on one hand and the general public first amendment rights on the other hand (Harr, Hess, & Orthman, 2012 366). Hence, the media is not allowed to attend every trial unless there is a compelling reason in doing otherwise, in particular the safety. The other boundary is when the coverage by the media can cause a business that the accused will be in danger due to disruption within the court, or the trial becomes somewhat of a three ring spectacle which in the end wipes out the dignified atmosphere as required in court proce edings (Harr, Hess, & Orthman, 2012 366). Change is likely to be un as yet and to create a sense of congenator deprivation, injustice, and threat among the losers.A recent instance is the pressure mounted on the government of Chad in ensuring t here is proper accounting procedures in the management of the countrys oil r regular(a)ue. The activities of these organizations have been twain positive and negative. From the positive side, they have been able to curb some of the excesses of governments in many developing countries, (African Centre for the Constructive Resolution of Disputes ACCORD, 2008). Traditional human rights theories rarely took conflict theories to exam the conflicts between different rights and social movements.Under conditions that human rights are violated or a particular class in society feels their rights are not fully being exercised, conflict can be seen as a normal phenomenon. In 1997, the Taiwan feminism movement was garbled by the sex workers issue. The major feminism groups denied sex could be seen as a right to work, but more tended to see it as a product by exploitation. To those support sex workers, they addressed sex workers have their rights to use sex or body as a work, and even further claimed that sex work is a radical sexual movement, (Ho, 2005).In such a situation, conflict is normal and beneficial as it acts as a podium of debate and its advantages of fostering an awareness of problems that exist and leading to better solutions is clearly seen. Above all the norms of society are readjusted. The more diversified and heterogeneous a society becomes, the greater the probability of more frequent conflict as subgroups who live by their own rules break the rules of other groups (Best, 2004). Conflict is a natural part of relationships. While relationships are sometimes calm and predictable, at other times events and circumstances generate tensions and instability. This phrase suggests that life gives us conflict, and that conflict is a natural part of human experience and relationships. Rather than viewing conflict as a threat, the transformative view sees conflict as a worth(predicate) opportunity to grow and increases our understanding of others and ourselves. Con flict helps us stop, assess and take notice. South Africa for example has a multiracial and multiethnic population. Blacks constitute 77% of which the Zulu convey up 22. % of the overall population, (ACCORD, 2008, 15).The liberation struggle during the years of white minority rule cemented the Blacks, Asians and coloured people together. The unity forged by the blacks, Asians and colored people under white oppression collapsed when state power was to be competed for by all groups. The conflict of power here is seen as a means of marriage these different groups for the purpose of achieving a common goal, (ibid, 2008). Furthermore, conflicts with some groups bring about fraternity. It maintains and revises the balance of power among antagonists. When conflict breaks out, the former accommodation between the parties involved is rejected, the relative war of each group is tested and a new equilibrium can be established. Such arrangements in the balance of power thwart any one group fro m being dominant over other groups. As long as their power is continually challenged, members of the ruling group will be blocked from exclusive control of the social system. In most African states where the fight for independence was intense, most ethnic groups worked together to secure independence.Conflict continually creates new norms and modifies old ones. It bringing about situations to which the usual rules do not apply, conflict stimulates the establishment of appropriate guides to action. Moreover, the threat of attack, preparation for war or any hostile challenge from outside can strengthen a groups solidarity and cohesiveness (Galtung, 1990). Conflict within and between social groups disturbs habits of thought and behavior and creates an atmosphere for innovation and creativity. This is another positive attribute of conflict that can be regarded as normal is that it facilitates the ovement or flow of one generation to the next. This is achieved in that society evolves over a period of time as values and norms of people continue to class and oppose each other within society. The changes may be positive hence benefiting humanity at large though in most cases these benefits are unanticipated and long-term. Finally, Weber contended that it will always exist, no matter of the social, economic, or political nature of society, and that it was functional because of its role in bringing disputes into the open for public debate.Even though individuals and groups enjoying great wealth, prestige, and power have the resources necessary to impose their values on others with fewer resources, Weber viewed the various class divisions in society as normal, inevitable, and acceptable (Curran Renzetti, 2001). However, it must be noted that if conflict is not managed, it pauses a great danger to humanity. If conflict is to be accepted as a normal phenomenon, it has to be managed or resolved quicker and more efficiently than letting it fester. For Mial and Wood House (20 01), by conflict resolution, it is expected that the deep rooted sources of conflict are addressed and resolved, and behavior is no seven-day violent, nor are attitude hostile any longer, while structure of the conflict has been changed. Desmond Tutu, the Anglican Archbishop emeritus of South Africa, is reported to have commented from within the situation of social revolution in South Africa that without reconciliation, there is no future (Wustenberg, 1998, 5).It is therefore now right to conclude that peace is a normal phenomenon but not when it is poorly managed or resolved. Issues such as the rearrangement of the balance of power, readjustment of group norms and the maintenance of group unity have been examined as the product of conflict even though conflict can be destructive in nature. Contemporary understanding of conflict represents a belief that conflict is not only a positive force of one group, but it is also absolutely essential for achievement of the efficiency of the g roup.

Pathway to Becoming an Engineer Essay Example for Free

Pathway to Becoming an steer EssayEngineering is two a theater and a profession that close toly deals with the activity of technical and scientific knowledge by the speci all in ally expert engineers. It involves the utilization of natural laws and physical resources in auberge to design and implement materials, structures, machines, devices, systems and processes which are aimed at realizing desired objectives in accordance with a specified criteria. These engineers apply scientific knowledge gained from such fields like mathematics and physics in order to happen solutions to problemsThe engineer profession is among the few super prestigious professions in the United States and as parents responded to a survey they said that they would like their children to enroll in such a profession. This being a fact it is important for those aspiring to be engineers to have some knowledge about the main requirements necessary for atomic number 53 to enroll for an engineering cou rse. It is a necessity for the aspirant to have a good enough foundation in the attainment based subjects in high schooling as these act as prerequisite for good performance in the engineering courses. This includes such subjects like Mathematics, biota,Physics,Chemistry, Mechanics and computer knowledge. The students should also have good knowledge in English and the Social Sciences since they also form part of the computer programme in the university. Apart from being good in the class bat more is also expected to have some character traits From a study done by Ross Harrison (1955) mechanical engineers were found to be emotionally inactive without any neurotic symptoms, goal oriented, serious minded, energetic while advocating for direct action when faced with problems.Other character traits found in the mechanical engineers was that they were serial forward people who rarely show analytical interest in other people. They also avoid introspection and self examination as revea led by the study. In addition they are expected to be trustworthy, honest, and maintain high take aims of integrity(Carbajal 2006). From these studies learners should seek to develop these traits although it is not such a requirement. Pre-college activitiesThere exists some program which students preparing to join engineering courses at the university lav enrol in. Most of these programs are organized by universities and are called Summer Programs. One such program that students can participate in is the Summer Undergraduate Program in Engineering Research at Berkeley (SUPERB). It is an eight weeks program that prepares students before they enroll for their studies and gives them an opportunity to participate in the area of interest.Another internship program that high school students can enroll in is the Science and Engineering Apprenticeship Program which is sponsored by the office of naval Research and offered annually. There are many summertime programs related to engineerin g studies but they take the already registered students during the summers. Main branches of Engineering. Engineering is a broad discipline which is often broken down into several sub disciplines all of which do concentrate on antithetical areas of engineering work.Over history the major notoriety branches of engineering are Aerospace (dealing with aircraft and spacecraft),Chemical(dealing with conversion of raw materials in to usable commodities),Civil(deals with design and construction of private and public works like bridges building), Electrical engineering which deals with design of electrical systems, Mechanical Engineering which deals with design of physical or mechanical systems, Computer Engineering dealing with design of software and hardware integration. With increase in technology new fields are coming up.Such fields include Software Engineering, Molecular Engineering, Mechatronics and Biomedical Engineering. Top engineering colleges in the U. S According to the ranki ng done by Graduates Hotline 2006 the best universities in engineering were ranked as, Massachusetts Institute of Technology being the best followed by Stanford University then third placed was University of California-Berkeley. The others were California institute Technology, University of Illinois at Urbana-Champaign, Georgia Institute of Technology, University of Michigan, Cornell, Carnegie Mellon and University of Texas at Austin in that order of the top ten institutions. How to find engineering colleges There are about 1,830 programs at colleges and universities that offer bachelors in engineering and in order for one to locate the best he/she should analyze whether they are accredited by the Accredition Board For Technology(ABET). The student should investigate the curriculum and check accreditions carefully before selecting a college. This because programs may have the same make out but vary in terms of the content to be covered. Enrollment into engineeringThere has been an increase in enrollment for graduate students in science and engineering fields in the U. S. Full time enrollment increased by 16% in the year 2006 to reach a peak of 343,603 students and this comprised of both foreign and U. S. Citizens(Oliver 2007). This increase was in all engineering subfields except for civil, agricultural and computer sciences. Typical first year engineering class. Different institutions have different first year programs for their engineering students. But in majority of the institutions students spend most of their first year while studying mathematics(Calculus,Algebra,Geometry) and basic sciences like Physics, Biology and Chemistry It is called the first year engineering transition program which helps students to upgrade their Grade Point Average and improve their academic standing. It also helps the students to prepare adequately for the subsequent years of study. The typical first year class is usually divided into two semesters with specified courses of st udy for each semester. These are the winter semester and the summer semester. The bachelors program is designed to last four years but mostly students find themselves taking up to five years to complete their degree programs. wideness of internships for students. The internships usually offered during the summer periods provide valuable experiences for the students. This because they provide first hand perspectives of a career and as such begin to realize the value of their courses. by internships students develop essential skills that are required on the job.Again they create opportunities through which students understand what is expected of them in the industry. They also explore their career in order to apply their skills and talents which rhyme with their interests. Internship periods have also been know to be transformative since during such times the students meet and overcome many challenges that come their way. This increases their confidence and capture to learn to achie ve. Licensure All states in the U. S require licensure of all engineers who offer their services directly to the public. Those who manage to get the license must be in possession of a degree from an accredited institution in addition to four years of relevant experience. They are also expected to sit and loss a state exam. After getting the license they are then referred as professional engineers. Salaries and employment for engineers The earnings for engineers vary depending on speciality ones level of education and the industry one works in. In the federal government the mean annual salaries for engineers in the year 2007 ranged from $75,144 in Agricultural engineering to $107,546.when all other groups of employees are considered it is the engineering group that earns the highest average starting salary. In the same year engineers held about 1. 5 million jobs in the U. S. Out of these jobs 37% was in the manufacturing industries while 28% was in the professional sector. As regards the federal state employment it employed 12% of all the engineers while 3% took consultancy as a form of self employment. One thing that is important for practicing engineers is for them to continue upgrading their education throughout their careers. This is because employers will attach more value to highly trained engineers as opposed to those who are not highly educated. Again promotion in this profession is closely associated with the level of education and as such the highly educated ones end up getting promoted easily. As mentioned earlier engineers play a very significant role in the society since they provide solutions to most of the problems that the society face. Therefore we can not under emphasize the role they play in the society as they apply scientific knowledge in meeting the societys need. They are viewed as very important people in the society and thus they should maintain the integrity in serving the society in line with the professional code of conduct.Works Cited Carbajal,C. and Ezequiel Chavez(2006).
